On 20 March 2018, the government of Portugal amended the law on the transfer of undertakings to strengthen employees’ rights. Employees now have the right to oppose the transfer of their employment contract if their contract remains with the transferring party. In that case, the transfer is considered as a just cause in a dismissal which entitles the employee to compensation. The transferring employees should also maintain all the acquired rights within their employment contract. In addition, the transferring party shall be jointly liable for all costs arising from the employment contract of transferring employees.
