Karnataka introduces paid menstrual leave

Karnataka recently introduced one day of employer-paid menstrual leave per month for female employees aged 18 to 52 years. This change took effect on 12 November 2025.

Background

The change was implemented by the Government of Karnataka through Government Order No. KAI 466 LET 2023 (the “Government Order”) issued on 12 November 2025.

Key details

The Government Order mandates that employers provide one paid day of menstrual leave per month (up to 12 days annually). Eligible employees include women aged 18 to 52 years, engaged as permanent, contractual, or outsourced staff. The Government Order does not specify whether this extends to both full-time and part-time staff.

This applies to all private sector establishments, including establishments registered under the Factories Act, 1948 and the Karnataka Shops and Commercial Establishments Act, 1961.

Eligible employees are not required to provide a medical certificate to utilize menstrual leave. Any unused menstrual leave cannot be carried forward.

Employer action: ACT

Employers should update their leave policies and procedures and employee handbooks, as needed, to reflect the new menstrual leave entitlement. The leave policy and procedures should be worded carefully to prevent any potential discrimination or stigma toward employees who choose to take this leave.

As contractual and outsourced female employees are also eligible for menstrual leave, employers should review and update outsourcing arrangements and service agreements to ensure that these employees receive the entitlement.
