The Irish Labor Court found in Kepak v Gráinne O’Hara (2018) that the employer was in breach of the Organization of Working Time Act 1997 for allowing an employee to send work emails outside of normal working hours that resulted in the employee working beyond the maximum work week. The employee was awarded EUR 7,500 based on the number of excess hours worked. The award should prompt employers to carefully review their tracking of working hours and compliance with working time regulations.
