Cannabis in the Workplace

Since 1996, when California first legalized the medical use of cannabis, states and local governments have readily taken action to legalize and decriminalize its use or possession. Today, the recreational use of cannabis is legal in near half of all states.

With cannabis use becoming more widespread, employers now face a variety of risks, and must balance employees’ rights under state laws against the requirements to maintain safe and drug-free workplaces, which is often mandated under federal law. Employers must also stay current with legal and political developments, review and update existing workplace policies, and carefully manage several employment issues and potential insurance claims in which cannabis may play a role.
